{"id":585,"date":"2022-10-04T19:55:06","date_gmt":"2022-10-05T02:55:06","guid":{"rendered":"https:\/\/unifor456.org\/?page_id=585"},"modified":"2025-08-17T17:08:02","modified_gmt":"2025-08-18T00:08:02","slug":"exhibit-c-welfare-plan","status":"publish","type":"page","link":"https:\/\/unifor456.org\/?page_id=585","title":{"rendered":"EXHIBIT C WELFARE PLAN"},"content":{"rendered":"<div class=\"boldgrid-section\">\n<div class=\"container\">\n<div class=\"row\">\n<div class=\"col-lg-12 col-md-12 col-xs-12 col-sm-12\">\n<p class=\"\">This Exhibit C sets forth the respective rights and obligations of the Company and its employees under the Welfare Plan which the Company has established pursuant to Article XXVII of the Labour Agreement between Kruger Products Inc., Western Manufacturing Division, and Unifor, Local 456.<\/p>\n<p>The employer will provide all employees with a deferred payment drug card which does not decrease the current provisions in the benefit plan.<\/p>\n<p>The Dispute Resolution Mechanism is as agreed to by the parties on May 23, 2001.<\/p>\n<p class=\"\"><strong>Section 1:\u00a0 Obligation<\/strong><\/p>\n<p class=\"\">(a) The Company signatory to the Labour Agreement will comply with the terms and conditions set forth in this Exhibit &#8220;C&#8221;, and provide the coverages required therein.<\/p>\n<p>(b) The coverages shall be subject to the usual and customary charges of the selected carrier or carriers.<\/p>\n<p class=\"\"><strong>Section 2:\u00a0 Waiting Period<\/strong><\/p>\n<p class=\"\">All full-time employees who are actively working and who have completed forty (40) days service shall be enrolled for the coverages and benefits set forth in &#8220;Schedule 1 of this exhibit.<\/p>\n<p class=\"\"><strong>Section 3: Dependents Covered Under the Plan\u00a0<\/strong><\/p>\n<p class=\"\">(a) Spouse of eligible employees.<\/p>\n<p>(b)Dependent children at their twenty-first birthday, or to their twenty-fifth birthday if in full time attendance at a recognized school or university, or until they marry or become wage earners, whichever occurs first.<\/p>\n<p>(c)Dependent children who become mentally or physically disabled while a covered dependent child as defined in (b) and has been continuously disabled at that time.<\/p>\n<p>Note: Employees may be required to prove that persons whom they claim as dependent children are actually dependent upon them.<\/p>\n<p class=\"\"><strong>Section 4:\u00a0 Costs<\/strong><\/p>\n<p>There will be a sharing of the net costs of the coverages and benefits made available to participating employees under the Welfare Plan as follows:<\/p>\n<p class=\"\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Company Employee<\/p>\n<p>\u00a0\u00a0\u00a0\u00a0\u00a0 Medical \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 100% \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 0<\/p>\n<p>Extended Health \u00a0\u00a0 100% \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 0<\/p>\n<p class=\"\">\u00a0\u00a0\u00a0\u00a0\u00a0 Group Life \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 100% \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 0<\/p>\n<p>\u00a0\u00a0\u00a0\u00a0\u00a0 A.D. &amp; D \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 100% \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 0<\/p>\n<p>Weekly Indemnity \u00a0\u00a0 70% \u00a0\u00a0\u00a0\u00a0\u00a0 30%<\/p>\n<p>Dental Care Plan \u00a0 100% \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 0<\/p>\n<p>Long Term Disability 70% \u00a0\u00a0\u00a0 30%<\/p>\n<p class=\"\">\n<p class=\"\"><strong>Section 5:\u00a0\u00a0\u00a0\u00a0 Reporting Period<\/strong><\/p>\n<p>The reporting period will cover the twelve (12) month period ending June 30.<\/p>\n<p class=\"\"><strong>Section 6:\u00a0\u00a0\u00a0\u00a0 Changes in Premium and Employee Contribution<\/strong><\/p>\n<p class=\"\">It is understood that any change in respect of either the premium rate charged by the carrier or the basis of the employer-employee sharing thereof may only be made effective not more often than once in any twelve (12) month period.<\/p>\n<p class=\"\"><strong>Section 7:\u00a0\u00a0\u00a0\u00a0 Distribution of Surplus<\/strong><\/p>\n<p>It is understood that surplus accumulation, if any, will be used only for the purpose of reducing premium costs.<\/p>\n<p>Surplus accumulations must be disposed of within reasonable time limits.<\/p>\n<p class=\"\"><strong>Section 8:\u00a0\u00a0\u00a0\u00a0 Disputes<\/strong><\/p>\n<p>No dispute arising out of the operation, administration or interpretation on any coverage contract between the Company and the Carrier shall be subject to the \u201cAdjustment of Complaints\u201d procedure of the Labour Agreement between Kruger Products Inc. and Unifor Local 456.\u00a0 Any such dispute shall be adjudicated under the terms of such coverage contract.<\/p>\n<p class=\"\"><strong>Section 9:\u00a0\u00a0\u00a0\u00a0 Disputed WorkSafeBC Weekly Indemnity Claims<\/strong><\/p>\n<p class=\"\">If an employee covered by the Welfare Plan suffers a disability, payment for which is in dispute with WorkSafeBC, weekly indemnity payments under the Welfare Plan will be paid retroactively as set forth in Schedule 1 of this Exhibit, if requested by the employee and provided they have been off work for at least 14 days due to the disability without WorkSafeBC having accepted the claim.<\/p>\n<p>If the WorkSafeBC claim is subsequently established, the employee will then repay the weekly disability payment received to the insurance company.<\/p>\n<p class=\"\"><strong>Section 10:\u00a0\u00a0 Claim while Negotiated Change Takes Effect<\/strong><\/p>\n<p>In the case of any employee who is on active claim arising from a disability which occurred before a negotiated change in benefits and which continues thereafter, the said employee shall, as from the effective date of the negotiated change, be paid the changed weekly indemnity benefit, be covered for the changed Group Term Life Insurance, and make the changed contributions.<\/p>\n<p class=\"\"><strong>Section 11:\u00a0\u00a0 Surviving Spouse and Dependent Coverage<\/strong><\/p>\n<p>Where a surviving spouse and dependents of a deceased employee are not covered by such plans by reason of their own employment, the Company will extend the coverage under the Extended Health Benefit Plan, for twenty-four (24) months following the death;
